Ath。Whenanyonecommitsanyinjustice，smallorgreat，thelawwilladmonishandcompelhimeitherneveratalltodothelikeagain，ornevervoluntarily，oratanyrateinafarlessdegree；andhemustinadditionpayforthehurt。Whethertheendistobeattainedbywordoraction，withpleasureorpain，bygivingortakingawayprivileges，bymeansoffinesorgifts，orinwhatsoeverwaythelawshallproceedtomakeamanhateinjustice，andloveornothatethenatureofthejust-thisisquitethenoblestworkoflaw。Butifthelegislatorseesanyonewhoisincurable，forhimhewillappointalawandapenalty。Heknowsquitewellthattosuchmenthemselvesthereisnoprofitinthecontinuanceoftheirlives，andthattheywoulddoadoublegoodtotherestofmankindiftheywouldtaketheirdeparture，inasmuchastheywouldbeanexampletoothermennottooffend，andtheywouldrelievethecityofbadcitizens。Insuchcases，andinsuchcasesonly，thelegislatoroughttoinflictdeathasthepunishmentofoffences。
