Withwhatfeelingsmustanenlightenedobservercontemplatethefurrowofalashimprinteduponthebodyofaman?Whatheartbeatsnotinunisonwiththesublimelawofantiquity,’ThoushaltnotinflictstripesuponthebodyofaRoman?’Thereisbutonealternativeinthiscase,onthepartofthesufferer。Eitherhismindmustbesubduedbythearbitrarydictatesofthesuperiorfortohimallisarbitrarythatdoesnotstandapprovedtothejudgementofhisownunderstanding;hewillbegovernedbysomethingthatisnotreason,andashamedofsomethingthatisnotdisgrace;
orelseeverypangheendureswillexcitethehonestindignationofhisheart,andfixthecleardisapprobationofhisintellect,willproducecontemptandalienationagainsthispunisher。
Thejusticeofpunishmentisbuiltuponthissimpleprinciple:Everymanisboundtoemploysuchmeansasshallsuggestthemselvesforpreventingevilssubversiveofgeneralsecurity,itbeingfirstascertained,eitherbyexperienceorreasoning,thatallmildermethodsareinadequatetotheexigencyofthecase。Theconclusionfromthisprincipleisthatwearebound,undercertainurgentcircumstances,todeprivetheoffenderofthelibertyhehasabused。Furtherthanthisperhapsnocircumstancecanauthorizeus。Hewhosepersonisimprisonedifthatbetherightkindofseclusion
cannotinterruptthepeaceofhisfellows;andtheinflictionoffurtherevil,whenhispowertoinjureisremoved,isthewildandunauthorizeddictateofvengeanceandrage,thewantonsportofunquestionedsuperiority。
Whenindeedthepersonoftheoffenderhasbeenfirstseized,thereisafurtherdutyincumbentonhispunisher,thedutyofendeavouringhisreform。Butthismakesnopartofthedirectconsideration。Thedutyofeverymantocontributetotheintellectualhealthofhisneighbourisofgeneralapplication。Besidewhichitispropertorecollect,whathasbeenalreadyproved。thatcoercionofnosortisamongthelegitimatemeansofreformation。Restraintheoffenderaslongasthesafetyofthecommunityprescribesit,forthisisjust。Restrainhimnotaninstantfromasimpleviewtohisownimprovement,forthisiscontrarytoreasonandmorality。
